Families say Zuma, Mbeki bid in TRC inquiry could delay long-awaited justice

The former presidents are seeking the removal of Justice Sisi Khampepe as chair of the inquiry.

The 25 families and survivors of apartheid-era crimes have opposed former presidents Jacob Zuma and Thabo Mbeki’s appeal bid in the Truth and Reconciliation Commission (TRC) inquiry.

The former presidents have applied directly to the Constitutional Court to appeal a Johannesburg High Court ruling that dismissed an urgent application seeking the removal of Justice Sisi Khampepe as chair of the inquiry.

Justice Khampepe’s recusal bid: A pivotal moment for TRC inquiry

If Justice Sisi Khampepe is not forced to recuse herself as chairperson of the TRC inquiry, the outcome of the commission will be doomed, and its findings will go “to the dustbin”.

This was the argument on Monday by Advocate Dali Mpofu before the Constitutional Court in a bid by former presidents Jacob Zuma and Thabo Mbeki to grant them direct access to. They want leave to appeal against the earlier judgment in which they lost their legal bid to have her removed.

It is a busy week ahead for the Constitutional Court, which will today hear arguments in former presidents Thabo Mbeki and Jacob Zuma’s legal bid to have former Justice Sisi Khampepe recuse herself from the TRC inquiry, while it will deliver judgment tomorrow in the rand-fixing saga.

The proceedings focused on whether the apex court may hear the matter directly and on complaints about Justice Khampepe’s prior roles and disclosure.

Former presidents Jacob Zuma and Thabo Mbeki’s review application was dismissed by the Johannesburg High Court in March.

The Constitutional Court will on Monday hear an urgent application for direct access and leave to appeal a High Court judgment that dismissed a bid to remove Judge Sisi Khampepe as chairperson of the Truth and Reconciliation Commission (TRC) cases inquiry.

Former presidents Jacob Zuma and Thabo Mbeki’s review application was dismissed by the Johannesburg High Court in March.

Former National Director of Public Prosecutions (NDPP) Advocate Mxolisi Nxasana has opened up about the challenges he faced while heading the National Prosecuting Authority (NPA) from October 2013 until his resignation on June 1, 2015.

Speaking on Thursday before the TRC Cases Inquiry chaired by retired Constitutional Court Justice Sisi Khampepe, Nxasana described a hostile atmosphere that severely impacted his ability to execute his duties effectively.

TRC Cases Inquiry resumes: Loyiso Jafta challenges allegations of interference

Following a month-long break due to alleged scheduling issues, the TRC Cases Inquiryresumed on Wednesday with testimony from State Security Agency Deputy Director-General (DDG) Loyiso Jafta.

During his hour-long evidence-in-chief, Jafta, who served in the Presidency during former president Thabo Mbeki’s administration, denied alleged interference by Mbeki’s administration in the probe of TRC-related cases.

Hearings in the Truth and Reconciliation Commission (TRC) cases inquiry resumed on Wednesday with testimony from State Security Agency Deputy Director-General Loyiso Jafta, who denied that the Mbeki administration interfered with investigations into TRC-related matters.
