Johannesburg – The Jacob Zuma Foundation says it will open a criminal case against retired Justice Sisi Khampepe after the Constitutional Court dismissed a bid by former presidents Jacob Zuma and Thabo Mbeki to have her recused from the TRC Cases Inquiry.
Foundation spokesperson Mzwanele Manyi said the patron would also lodge a complaint with the Judicial Service Commission.
“What lies ahead is that the patron of the foundation will do two things. One, we’re going to open a criminal case against Justice Khampepe. There’s evidence in the papers that there’s something that she’s done which is unlawful between herself and the evidence leader.”

The Constitutional Court has dismissed former presidents Jacob Zuma and Thabo Mbeki’s bid to have retired Justice Sisi Khampepe recused from an inquiry into alleged political interference in apartheid-era Truth and Reconciliation Commission cases.
The apex court handed down its judgment on Monday, allowing Khampepe to remain as chairperson of the Judicial Commission of Inquiry.
However, it granted the two former presidents leave to appeal the High Court’s ruling.

The Jacob Zuma Foundation has described the Constitutional Court’s split ruling on retired Justice Sisi Khampepe’s recusal as a “narrow loss”, saying the 4‑4 divide reflects the seriousness of the former president’s concerns.
Zuma and another former president, Thabo Mbeki, failed in their latest attempt to have Khampepe removed as chairperson of the Truth and Reconciliation Commission (TRC) cases inquiry after the ConCourt dismissed their review application on Monday.
The court, however, granted the former presidents leave to appeal, allowing the matter to proceed.

Apartheid-era cop Daniel Siebert denies intent to kill Biko.
Former Security Police Captain Daniel Siebert has given the reopened Steve Biko inquest his account of the interrogation that preceded Biko’s fatal injuries, telling the Gqeberha High Court that Biko became upset when confronted with information about a political pamphlet and subsequently resisted the officers.
Siebert joined the South African Police Force in January 1962 and served in the Gqeberha Security Branch from 1967 to 1981.
He testified virtually with his advocate Advocate Marius Van Zyl SC who read his affidavit, with Judge Isaac Madondo questioning him about the events of 6 September 1977, when Biko was taken from Walmer Police Station to the Security Police offices in the Sanlam Building for interrogation.

Apartheid-era cop labels Steve Biko as ‘aggressive’

GQEBERHA – Former apartheid-era police officer Daniel Siebert claimed Steve Biko was aggressive during his detention.
Siebert testified virtually at the Gqeberha High Court on Friday, at the reopened inquest into the 1977 death of the anti-apartheid activist.
“On the said date, the deceased was brought from the police station where he was detained to the offices of the security branch in the Sanlam building in PE ( Port Elizabeth) for the purposes of questioning.
“The deceased was, according to my recollection, aggressive and reluctant and refused to answer pertinent questions,” Siebert said.

Biko Family Challenges Madondo Ruling as It Seeks Inquest Stay
Former apartheid security policeman Daniel Petrus Siebert has told the reopened inquest into Steve Biko’s death that several Security Branch officers wrestled with the activist during an interrogation, while one officer struck him with a cut garden hosepipe.
Siebert, now 80, said Biko hit his head against a wall during the struggle at the Security Branch headquarters in Gqeberha (then Port Elizabeth) on 6 September 1977.

Gqeberha – The Biko family has filed papers in the Eastern Cape High Court seeking an interim stay of the reopened Steve Biko inquest, pending a review of retired Justice Isaac Madondo’s ruling of 26 August 2026.
That ruling dismissed the family’s bid to postpone the hearing. The family says the record is incomplete, key documents remain in Afrikaans, and their legal team was funded and briefed too late to prepare. The inquest itself is still listed to sit, with surviving security-branch officers among those expected this week.
